1. Agreement
By creating an account or using any CudoHost service, you agree to be bound by these Terms of Service. Non-compliance may result in service unavailability. These terms cover all users of our website and APIs.
2. Services
CudoHost delivers web hosting and related offerings. We reserve the right to modify, suspend, or discontinue services with reasonable notice. Service specifications match those described at the time of purchase.
3. Identity Verification
Fraud prevention requires identity verification. Before activation, users must complete verification and provide accurate government-issued identification plus any requested documentation. We may delay, suspend, or refuse activation — and may terminate an existing account without refund — if verification fails, is declined, or submitted information proves false, incomplete, or fraudulent. Our Privacy Policy governs the information collected.
4. Account Responsibilities
Users must maintain credential security, ensure their activity complies with the Acceptable Use Policy, keep billing information current, and take responsibility for all deployed content.
5. Billing & Payment
Plans are billed in advance on a monthly, annual, or multi-year basis. Payments are non-refundable except as set out in our Cancellation & Refund Policy. Failed payments may trigger suspension. Any price-lock guarantee applies only to the billing term in effect at the time of signup.
6. Refund Policy
Eligible new customers may request a refund within the period stated in our Cancellation & Refund Policy. Thereafter, payments remain non-refundable. Refunds for service credits due to verified downtime below our SLA are issued as account credit, not cash.
7. Service Level Agreement (SLA)
We target 99.9% monthly uptime for hosting services. Downtime is measured in consecutive minutes of complete inaccessibility. SLA credits of up to 100% of the monthly fee may be applied as account credit upon request for verified downtime.
8. Prohibited Activities
Use of our services for prohibited activities (as detailed in our Acceptable Use Policy) will result in immediate termination without refund. Examples include spam, DDoS attacks, hosting illegal content, and cryptocurrency mining.
9. Limitation of Liability
CudoHost's total liability for any claim arising out of or related to these terms or our services shall not exceed the amount paid by you for the service in the 3 months prior to the claim. We are not liable for indirect, incidental, or consequential damages.
10. Termination
Either party may terminate services with 30 days' written notice. Immediate termination may occur for term violations or Acceptable Use Policy breaches. Upon termination, your data will be deleted within 30 days. You are responsible for backing up your data beforehand.
11. Governing Law
These terms are governed by the laws of the United States and the State of Texas. Disputes shall be handled by the courts located in Austin, Texas.
